PERLINDUNGAN HUKUM BAGI SAKSI PELAKU YANG BEKERJA SAMA DALAM PENANGANAN PERKARA TINDAK PIDANA KORUPSI

Abstract

The handling of criminal acts of corruption requires an effective law enforcement strategy, especially in obtaining accurate information and sufficient evidence. In this context, the existence of cooperating witnesses is an important tool because it can reveal a more comprehensive picture of criminal events. On the other hand, the role of crime reporters also plays a major role in encouraging the disclosure of cases from an early stage, thereby increasing the chances of success in the law enforcement process. This study discusses how the legal position of cooperating witnesses and crime reporters affects the effectiveness of handling corruption cases. The analysis was conducted through a normative juridical approach by examining relevant laws, regulations, doctrines, and court decisions. The results of the study show that optimizing both requires legal certainty, adequate protection mechanisms, and consistent enforcement of rules to strengthen ongoing efforts to eradicate corruption. The research method used in this paper is normative legal research, which views law as a system of norms consisting of principles, rules, legislation, court decisions, agreements, and doctrines related to legal protection for witnesses who cooperate in criminal corruption cases. Based on the results of the research, it can be concluded that the Criminal Code (KUHP) does not explicitly regulate legal protection for witnesses. The provisions in the KUHP only emphasize the obligation of witnesses to provide information, and if this obligation is not fulfilled, witnesses may be subject to criminal penalties as stated in Article 224 of the KUHP, as well as fines as regulated in Article 522 of the KUHP.
